This notice (“Notice”) informs you about our processing activities, which involve the collect and use of your personal information (“data”).  Your data may be collected and used to create your account, conduct the hiring process and perform HR-related management activities and tasks including:

  • To allow you to create an account (“your Candidate Profile”) before submitting your application;
  • To allow you to apply for a specific job opening in an Entity that belongs to ENGIE North America Inc. or its affiliates and its subsidiaries (“ENA”, “we” or “us”). The relevant entity is indicated within the specific job offer;
  • To allow you to join the pool of candidates used by ENA to promote its offers, according to the visibility preferences you have selected (see “Make My Profile Visible to” section);
  • For recruiters, to manage your application including: 

      - Storing and reviewing your Curriculum Vitae and any information you provided;

      - Reviewing your Curriculum Vitae using an automated tool (identifying and selecting candidates via an automated process); and

  • To allow you to subscribe to the publication of other ENGIE Job offers and/or newsletters. 

If you are a California resident, this Notice considers the rights you may exercise, and obligations set forth in the California Consumer Privacy Act (“CCPA”).

In this data processing, we might collect the following categories of personal information provided by you or from publicly available sources, which may include certain sensitive personal information:

  • Identifiers (e.g., name, surname, phone number, email address, mailing address);
  • Education information (degree, credential and dates);
  • Protected classification information (e.g., gender, race/ethnicity, military or veteran status, disability); This information is collected and used for diversity and inclusion initiatives at ENGIE and remains strictly confidential and kept separate from the hiring process.
  • Professional or employment-related information (e.g., Curriculum Vitae, position and job occupied, characteristics of the position sought by the candidate); and
  • Candidature/application process related information including the application submission information (sourcing, social networks, spontaneous application), the results of tests carried out as part of the recruitment process (e.g., technical skill evaluation, language skills test) background check status and the general assessment of the suitability of the application for the position to be filled.

Your candidate data will be retained on the platform for 4 years, in line with legal requirements and applicable statute of limitations.  Information related to your application and assessment of suitability for a job position is retained for a specified period after the recruitment process ends if you are not selected for the position.

Your data will be processed by ENA’s administrative and recruiting services.  It can also be accessed by certain ENGIE IT employees and subcontractors (Accenture, Textkernel and SAP) for application maintenance, based on the need-to-know principle.

Your data may be transferred outside the United States, particularly to ENGIE IT subcontractors in India for application maintenance. Such transfers will be subject to reasonable controls to protect your information, and access by ENGIE employees is governed by the binding corporate rules.

While creating your account, you will have the ability to choose the visibility level of your Candidate Profile and personal information associated, amongst the 3 following options:

Option 1: all recruiters at ENGIE to also consider you for other matching positions and candidate pools for additional career opportunities worldwide;

Option 2: Only ENA recruiters in your country/region to also consider you for other matching positions and candidate pools for additional career opportunities worldwide;

Option 3: Only recruiters that are responsible for requisitions you applied to.  Therefore, you neither wish to be considered for other matching positions nor for candidate pools.

You can change this option anytime by accessing your Candidate Profile in the ENGIE Candidate Portal.

Use of the automated decision-making technology:

ENGIE uses TextKernel tool in its recruitment activities to help recruiters efficiently and objectively find the most qualified and suitable candidate for a job position.

Textkernel automatically processes your application/resume to identify your skills, qualifications and professional experience using keywords selected by the recruiter.

TextKernel’s algorithms sort your application based on how well it matches the search criteria (e.g., skills, professional experience and qualifications).  Your application is ranked with a compatibility score, based on the “match” between the recruiter’s keyword selected for the relevant position and your resume.

The recruiter then analyses the sorted list of candidates and decide who will proceed in the recruitment process.

Textkernel is defined as an ‘Automated Decision-Making Technology” under California final draft of regulations on ADMT, providing additional rights to the candidates.

You may request access to further information on ENA’s use of this technology, including the underlying logic, the process and its impacts on the final decision. Please make your request to privacy.engiena@engie.com.

Opt-Out via Checkbox:

If you are a Californian resident, you may also opt-out of the use of an automated decision-making technology.  If you wish to opt-out of the automated part of the hiring process, while creating your account, please check the box that states “If you are a California resident and do not consent to your data being used by an automated decision-making technology, including profiling, to assist in making decisions about your candidature or candidate profile, please check this box ».  If you tick this box, your data will not be sent to the tool, and your candidature will remain visible on the platform for recruiters to review.

You can opt-out or change your choice at anytime in your Candidate Profile.  If you opt-out after submitting your application, your data will be removed from the automated tool (Textkernel), but your application and profile will still be visible to recruiters.  By unchecking the box in the Candidate Profile, your data will be sent to Textkernel.

In accordance with the applicable regulations and based on your residency, you may exercise your right to access, correct or delete your personal information.  You may also have the right to opt out of using an automated decision-making technology and to limit the use of your sensitive personal information under certain conditions.

Please note that in order to process your request to access, correct or delete your personal information we must be able to verify your identity and then request you provide additional information as proof of your identity. You may use an authorized agent to submit your privacy request, by submitting a request at privacy.engiena@engie.com or by mail with the subject line “Authorized Agent Request”.

If you believe that one of your rights have been violated, you can submit a complaint to the California Protection Privacy Act (https://cppa.ca.gov/webapplications/complaint) and/or to the California Attorney General (https://oag.ca.gov/contact/consumer-complaint-against-business-or-company).
